Zivio ("Zivio", "Platform") is operated by Last Train to Juarez LLC, an Arizona limited liability company ("we", "us", "our").
These Terms of Service ("Terms") govern your access to and use of the Zivio platform, including artist tools, fan portals, messaging systems, analytics tools, marketing automation features, and related services (collectively, the "Services").
By accessing or using the Platform you agree to these Terms and our Privacy Policy. You must be at least 18 years old to use Zivio.
Zivio provides a marketing, engagement, and operational platform designed for musicians, artists, venues, and live-event professionals.
Accounts are licensed for individual artists or organizations and may not be resold, shared, white-labeled, or operated as a third-party agency platform without written permission from Zivio.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account, including messages sent, campaigns created, contacts uploaded, and data accessed.
Platform subscriptions are billed monthly unless otherwise stated. Fees are generally non-refundable except where required by law. Messaging credits remain active while the account remains active and may expire after account cancellation.
You represent and warrant that you have obtained all legally required consent before uploading, importing, or messaging any contact through Zivio.
SMS and MMS messaging must always be opt-in. Contacts must explicitly consent to receive communications from you. Attempts to bypass consent requirements or re-import unsubscribed contacts are strictly prohibited.
Zivio automatically enforces STOP, HELP, and opt-out compliance where applicable. Violations may result in suspension or termination.
Zivio may allow users to connect Facebook Pages, Instagram accounts, or Meta advertising accounts to enable features such as automated responses, engagement monitoring, or advertising campaign management.
By connecting your Meta assets, you authorize Zivio to access and use certain information made available through Meta APIs in accordance with Meta Platform Terms and applicable developer policies.
Zivio may use authorized access to create, edit, manage, and report on advertising campaigns, audiences, ads, and related objects on behalf of the user.
Users may revoke Zivio's access to their Meta assets at any time through Meta Business Integrations settings or by disconnecting the integration within the Zivio platform.
Zivio does not sell or misuse Meta platform data and uses such data only to provide the functionality requested by the user.
Zivio relies on third-party service providers including hosting providers, messaging carriers, payment processors, analytics tools, and social platform APIs. These providers operate independently and their services are subject to their own terms and policies.
All software, technology, designs, and platform functionality are owned by or licensed to Zivio. Users retain ownership of their content, contact lists, and media uploaded to the platform.
We may suspend or terminate accounts that violate these Terms, carrier rules, Meta platform policies, or applicable law. Termination does not entitle you to refunds.
The Platform is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Zivio's total liability shall not exceed the amount paid by the user during the twelve months preceding the claim.
These Terms are governed by the laws of the State of Arizona. Any disputes must be resolved exclusively in courts located in Phoenix, Arizona.
